Yet another blow for bars and restaurants in commercial centres.

After being told that from 11 May they can open their terraces for up to 50% of their licenced tables, the local police are now going round telling them to close because they are in a commercial centre.

Before anyone says that they know diifferent, this is a Facebook post from a very good friend of ours.

No wonder people are getting p*ssed off with it all. !!!

Hello Everyone. Some of you might have heard that Policia Local have determined that bars and restaurants located within commercial centers are not allowed to open their terraces, so unfortunately we have to cancel all reservations taken for the weekend and coming week. We are still offering a takeaway and delivery service ❤️🥢
There is much confusion as to why this is happening, so I have copied and google translated the following letter from my Gestoria, as to why we, and many other businesses were told that we could open

On May 9, the SND / 399/2020 Order of May 9 was published in the Official State Gazette, for the relaxation of certain national restrictions, established after the declaration of the state of alarm in application of phase 1 of the Plan for the transition to a new normal.
Chapter III article 10 establishes the Conditions for the reopening to the public of retail establishments and premises and the provision of similar services related to retail establishments (stores and retail trade) and professional services, limiting their opening to those of less than 400 square meters and those that are not located in shopping centers.
At the same time and in a separate chapter (Chapter IV) in article 15 the Order regulates the Conditions for the reopening of terraces of the hotel and restaurant establishments to the public, not imposing any type of limitation on the opening of these establishments, neither by dimensions of the premises or by location inside or outside shopping centers. The establishments that provide restaurant and hospitality services are not retail and therefore the opening limitations regulated for them in article 10 do not apply to them and this is how the legislator understands them by legislating the opening conditions of bars and restaurants in another chapter and different article.
We understand that there is no limitation to the reopening of terraces of hotel and restaurant establishments due to the size of the premises or their location in a shopping center or outside it according to article 15 of Order SND / 399/2020, of 9 May, for the relaxation of certain national restrictions, established after the declaration of the state of alarm in application of phase 1 of the Plan for the transition to a new normality.

I believe it stemmed from la zenia boulevard businesses complaining that they couldnt operate as they exceeded the 30% capacity limit of people and 50% of tables , up to 400 mtr 2 and thought it unfair other smaller commercial centres were not under the same ruling , ie villa martin plaza, la fuente, etc
