Hi all,
Now that brexit is done, most things are changing. does anyone know the situation regarding inheritance tax rates for non-EU, non-resident homeowners?
I know it used to be a far higher rate for brit owners in Spain, then the EU forced Spain to equalise the rates for all EU owners to the same rate as Spanish residents but I assume that is out of the window now.

I would ask a solicitor.

People might pist what they think and with good intention but with something important like this a good solicitor would be best.

Probably to soon after leaving for that experience.

Knowing Spanish solicitors, it might be best to also get a second opinion on the firsts opinion ;)

I remember reading an article where a Canadian woman took the Spanish Government to the ECJ for being in breach of EU law on SSGT - Succession and Gift Tax -This article from Blevins Franks gives a summary of the judgement where Spain was found to be in breach of SSGT - Succession and Gift Tax law as it applied to non-EU non-resident heirs. Although the Spanish SSGT tax law in relation to regional inheritance tax allowances has not been officially changed nevertheless the Government now accept it can be applied to non-EU testators and heirs so UK resident heirs, depending on relationship to the deceased, will benefit from the Comm Valenciana €100K inheritance tax allowance.

Capital gains tax is higher for non EU citizens. 5% higher I believe at 24%.
