You still need to legalise the apartment i believe fred even if going through a third party like Airbnb
And as mentioned probably obtain permission from the urb regarding swimming pool use etc
I know the president will only issue a key pass for the pool to the owner for sole use so this could also be a problem

Yes you will need a Tourist Licence so first stop is the Town Hall to check if they approving them then you need to check if the urb allows them, if all ok then apply for a Tourist Licence it will be about 1 year to 18 months before you get one then you have to register it with the Guardis Civil and all guests must be entered into the register at the Guardia office there is an App for doing this .
If all legal the President can not stop tenants using the pool that is against the law and carries a very large fine

Thanks for the information Fred , much appreciated
He wont be happy if it takes 12 to 18 months to secure a licence but if thats the case then there is nothing more to do but wait
cheers

I can't see any problems from the Town Hall as Orihuela Costa is a holiday resort.

HOW TO APPLY FOR THE TOURIST LICENSE IN THE VALENCIAN COMMUNITY

In the Valencian Community, the procedure consists of two steps:

First, you will have to go to the Town Hall of the town where the house is located to request the Certificate of Urban Compatibility for Tourist Property. Depending on the City Council, one documentation or another may be required for your application, the most frequent documentation that is usually requested is the following:
Facade photography
Interior plan of the house
House situation plan
Ownership deed
DNI/NIE/Passport
First or second occupation license
Current liability insurance
Payment of the corresponding fee

Once the Certificate of Urban Compatibility for Tourist Housing has been issued by the City Council, the next step is to go to the Generalitat Valenciana to present the following documents:
Responsible declaration regarding property for tourist use
Certificate of urban compatibility provided by the corresponding Town Hall.
Deeds
First or second occupation license
Current liability insurance
DNI/NIE/Passport
This process can be done in person or through the following link.

HOW TO APPLY FOR THE TOURIST LICENSE IN THE REGION OF MURCIA

In the case of the Region of Murcia, the process is simplified.

The application is only made at the Electronic Office of the Autonomous Community of the Region of Murcia (CARM) through the 1890 procedure at the following link. The documentation to be provided would be the following:

Interior plan of the house
House situation plan
Liability insurance
First or second occupation license
Property deed
DNI/NIE/Passport
In addition, the Region of Murcia offers the possibility of advertising accommodation on its website www.murciaturistica.es

IMPORTANT: The tourist license is MANDATORY to rent the house under a tourist regime through platforms such as AirBnb or Booking, at Blau Abogados we have extensive experience in this matter and we can help you manage the application and the whole process and advise you on all the tax and legal requirements to start-up of the vacation activity.
